備詢官員：內政部次長董建宏、主計長陳淑姿、農業部次長黃昭欽 【賴政府獨步全球法學見解 綠能你不能！】 2025-12-24 財政委員會 立法院三讀通過《警察人員人事條例》，提高警消退休所得替代率。近日，銓敘部陸續發放依新法計算退休審定函，但因為內政部遲未編列預算，以警政二階一級為例，每個月至少就短少5千多元，政府欠的錢，內政部何時要給？今天內政部持續主張已經提起釋憲，但提起釋憲就可以暫停給付嗎？這什麼獨步全球的法學理論？ 行政院一再主張，立法委員提出的法律案增加預算，若無行政院同意就違憲。之前賴清德提名的司法院院長被提名人蔡秋明表達得相當清楚，他認為基本上不違憲。或許是認為憲法法庭五位司法獨夫都是民進黨控制的，行政院才敢如此囂張。 剛好今日立法院衛環委員會正在審理提高老農津貼的修法，包含民進黨多位委員在內都有提出修法，難道這些修法是違憲的嗎？ 可笑的是，主計長拿出《預算法》與《財政紀律法》當擋箭牌，但行政院不是主張違憲嗎？怎麼會拿法律胡扯？主計長更說，要看民進黨立委提出修法有無跟行政院做溝通，難道是只要行政院點頭就不違憲？行政院不點頭就違憲？一切都是行政權說的算？ 更不要說，老農津貼於2005年提高時，正是民進黨立院黨團包含柯建銘與賴清德在內的立委提案，讓人難以理解，賴清德自己當立委修法提高老農津貼不違憲，今天立委提出修法增加預算就違憲，完全是綠能你不能！
