WATCH: Jack Smith testifies publicly about his Trump investigations | House Republicans LIVE | CNBC TV18 Jack Smith defended his decision to obtain non-disclosure orders that prevented lawmakers from learning that their phone records had been subpoenaed by pointing to how election workers had been targeted by President Trump and his alleged co-conspirators. “I was aware, during the course of our investigation, of targeting of witnesses during the course of the conspiracy itself,” Smith said. “There were election workers who had their lives turned upside down and received vile death threats because they were targeted by Donald Trump and his co-conspirators.” Smith said in his testimony that he didn't charge Trump with insurrection in the election interference case tied to the president's efforts to overturn the 2020 presidential election results. "With respect to the charge of insurrection, we did not charge that," he said. Smith explained that while he believes courts found that there was an insurrection on Jan. 6, 2021, and that "a reasonable prosecutor could interpret the evidence to support that charge, I chose not to do that." Jack Smith, the former special counsel who oversaw two investigations into President Trump that resulted in more than 40 federal charges, will testify publicly for the first time on Thursday at a hearing before the House Judiciary Committee. The testimony comes as the committee probes Smith's actions during his time as special counsel in the Biden administration. Smith's investigations dealt with Mr. Trump's retention of sensitive government documents after leaving the White House in 2021, and his actions in the wake of the 2020 election. Both cases were brought to an end after Mr. Trump won a second term in November 2024. The president has denied any wrongdoing. In December, Smith testified before lawmakers for more than eight hours at a closed-door deposition. He defended his investigations and said he was confident that he had sufficient evidence to convict Mr. Trump at trial.
